Landlord's Deposit claims update

Danielle Stuckey reveals the latest data on Landlord's claims.

"Having studied some randomly selected cases submitted to The Dispute Service, (www.thedisputeservice) it is evident that without a proper Inventory, landlords often fail to prove dilapidations and therefore lose their claim for all or part of a tenant’s deposit." cautions Danielle from Woodward Estate Agents letting team.

Danielle provided the following examples:

Amount DisputedInventoryAward to Tenant Award to Landlord
 £875No £219 £656
 £759Yes £759 nil
 £465No £100 £365

Lawrence Greenberg, Chief Executive of The Tenancy Deposit Scheme said:

"It is never simple and sometimes awards have to take account of a lack of documentary evidence like photographs. Sometimes apparent damage or poor condition is no more than the result of normal wear and tear. However, in all the cases, with the benefit of hindsight it is easy to spot where the molehill became a mountain. Good inventory and condition reports often help to remove that mountain from the problem."
